You should contact a personal injury attorney as soon as possible - ideally within the first 24 hours. Frequently, the most important time to your claim will be the first several days after your injury. During this time, a lawyer can provide valuable guidance and legal advice to assure your claim is protected. Although it may not be necessary to hire a lawyer immediately, it is necessary to consult with one as soon as possible.
- Should I discuss the accident or the cause of my injury with my doctor?
Absolutely; it is very important that your doctor know the cause of your injury in order to treat you properly and to determine if your injury is related to the accident. If your doctor is unaware of the accident or the cause of your injury, he or she may be unable to provide quality treatment and may be unable to provide credible opinions regarding your claim.
- Should I tell my doctor about injuries or treatment in the past?
Definitely; if you fail to provide your doctor with an accurate and detailed medical history, a defense lawyer may attack your credibility and your doctor's opinion at trial.
- How much is my case worth?
It depends on many factors, including the cause of your injury (liability) and the extent of your injuries (damages). Generally speaking, your attorney cannot finish evaluating your claim until your doctor has released you from further care or you reach maximum medical improvement (MMI). Once you reach maximum medical improvement (MMI), your attorney can obtain your doctor's opinions about your limitations and future medical needs. At this point, your attorney will be able to advise you on the fair value of your case.
- How long will it take to resolve my claim?
Each claim is different. Some cases resolve in as little as days or weeks. Other cases take several years or more to resolve. The answer will depend on the unique facts of your case.
